REAL ESTATE

The first thing that probably comes to mind when you hear "real estate" is the purchase of a home. Myron E. Siegel & Associates handles real estate closings as well as other lesser known areas of real estate law.

Quiet title actions are a lesser use form of real estate law. The purpose of filing a quiet title action is to clear title to property when the other parties to the lawsuit will not cooperate, cannot be found, or simply disagree. Quiet title actions are generally based upon some written evidence of ownership of the real property. As an example, a corporate client was given a deed to a property; however the corporation was not properly formed and could not take title to the property. The error was not discovered until sometime later and it was not possible to obtain a corrective deed from the previous grantor because the previous grantor could not be located. It was necessary to file a quiet title action for the Corporation to obtain good title to the property. This is rare, but it is an important tool in correcting bad titles.

Another lesser known real estate law action is partition. The partition is an action in which the court is asked to divide real estate between two owners, or to determine that the real estate cannot be divided, and to order the sale of the property. This is used when there are two or more owners who cannot agree on what should be done with the property, or on whether the property should be sold. Generally the property cannot be divided into two parts, so the court is asked to order the property sold and the money divided between the parties.

The real estate action which has received the most attention lately is foreclosure. I'm sure you're all familiar with foreclosure from all that you have heard on the news. Foreclosure is simply a forced sale of the property so that a lender can recoup all or a portion of the funds which the lender loaned to the property owner. Our office participates in foreclosure actions on behalf of the lender, and we also participate in foreclosure actions defending the property owner.

Real Estate Tax Complaints and Appeals (Illinois)

Myron E. Siegel & Associates has skilled professionals that understand the complicated process employed by assessors in determining the value of real property. The methodology used which id determine by type of property in some cases and the county of location, the assessment percentage, the equalization factors, the tax rate and applicable exemptions affect the final tax bill. We review the property record card for errors and help gather evidence to support a complaint seeking an assessment reduction.

Our representation may include appearing before the Assessor, the Board of Tax Appeals, the Board of Review and the Illinois Property Tax Appeal Board. We handle these complaints for single family homes, multi-family buildings, undeveloped lots, subdivisions, homeowner's associations, commercial properties, banks, recreational complexes, apartment buildings, condominium developments and high-end residences.
